Terms and Conditions

1) SITE CONTENT, OWNERSHIP, AND USAGE LIMITATIONS

The materials on this website are safeguarded under Australian copyright laws, as well as international treaties. Except where explicitly noted and excluding information or links from third-party websites, all rights—including copyright—to all content, materials, and compilations found on or used to create this site, such as text, images, logos, icons, videos, audio clips, and software (collectively referred to as the "Content") are owned, managed, and protected by JMB Draft & Design and its affiliates, licensors, and licensees. We may display images of final products made through various production methods to highlight our capabilities.

Images owned by third parties may be used on the site, but JMB Draft & Design does not claim ownership of these products or images. These are displayed solely to demonstrate the potential of our services.


2) HANDLING OF CONFIDENTIAL INFORMATION

All Confidential Information provided to JMB Draft & Design remains the client’s property. Any documents or materials supplied by the client will be destroyed by JMB Draft & Design upon completion of the project.


3) UNAUTHORIZED ACTIVITIES

Without prior written consent from JMB Draft & Design or any other content rights holder accessible through the site, you may not reproduce, frame, download, store (in any medium), communicate, publicly display or play, adapt, modify, or create derivative works from any content.

No trademarks (whether registered or not) featured on this site or used by JMB Draft & Design may be used without specific, prior written approval from us or the trademark owner.


4) INFORMATION ACCURACY, COMPLETENESS, RELIABILITY, AND TIMELINESS

We do not assume responsibility if the information presented on this site is inaccurate, incomplete, or outdated. The content provided is for general informational purposes only and should not be solely relied upon for decision-making without consulting primary, more precise, or more current sources of information. Any reliance on the site’s material is at your own risk. This site may contain historical data, which is not current and is provided solely for reference. We reserve the right to alter the content of this site at any time, with no obligation to update any information. You agree to monitor changes to our site. We do not guarantee that any products, services, information, or other materials purchased or referenced by you will meet your expectations, nor do we guarantee that any errors in the service will be corrected. Tolerances for manufacturing or engineering, including allowable variations in dimensions or material properties based on specific processes, are within acceptable limits for technologies such as 3D printing, CNC machining, vacuum casting, and injection molding. Rejection based on these tolerances is not permitted.

The final product's overall quality may vary depending on design standards and complexity, and no refunds will be provided if you are dissatisfied with the quality. Although we strive to ensure the accuracy of the information on this website, JMB Draft & Design, its officers, employees, and agents disclaim all liability (except where liability cannot be excluded by law) for any errors, inaccuracies, or omissions in the information provided or for any loss or damage incurred directly or indirectly due to reliance on this information.

Any advice or suggestions offered are based on general usage and application. If you are unsure, please seek professional advice before making a decision.

You must acknowledge the limitations of 3D printing technology before finalizing any product or service agreement.


5) SHIPPING AND DELIVERY

JMB Draft & Design will make every effort to meet the quoted shipping dates, but we are not liable for any special, incidental, or consequential damages due to delivery delays or inability to deliver. Quoted prices do not include customs duties, GST, freight, or insurance. If the buyer arranges their own freight carrier, ownership and risk of loss transfer to the buyer when the freight carrier picks up the shipment. In the absence of specific written instructions from the buyer, JMB Draft & Design will select the common carrier. The buyer is responsible for any freight and insurance charges, which will appear as separate items on the invoice. The buyer is also responsible for ensuring that accurate delivery instructions are provided to JMB Draft & Design. If incorrect delivery information results in additional shipping fees, these fees will be charged to the buyer. If products are shipped freight prepaid, the buyer shall pay JMB Draft & Design the appropriate freight and insurance charges, which will be itemized on the invoice. Please allow 2-3 weeks from the purchase date and/or check clearance for the product to ship.

Due to the nature of 3D printing and other production processes like CNC machining, injection molding, or vacuum casting, delays may occur due to factors beyond our control. In such cases, refunds will not be provided.


6) DAMAGE AND SHORT SHIPMENTS

If products are received damaged, retain all packaging materials and contact both the carrier and JMB Draft & Design in writing within THREE working days of receipt. If noticeable damage, such as broken crating or torn wrapping, is found on 3D printers, other machinery, or 3D printed products, the buyer MUST note on the driver’s release records: “SHIPMENT PACKAGING IS DAMAGED, AND TIME FOR FURTHER INSPECTION OF PRODUCT WILL BE NEEDED TO FILE A CLAIM IN THE EVENT THE PRODUCT IS ALSO DAMAGED.” This will allow time for inspection. It is also recommended to take photographs of the damage. Signing the driver’s form without adding this statement releases the driver or shipping company from liability for any damage caused.


7) PRICING, TAXES, AND PAYMENT

All prices are per unit (unless stated otherwise) and are in Australian Dollars (AUD). Prices are subject to change without notice. Taxes, such as import taxes, that JMB Draft & Design is required to collect in connection with the sale or delivery of products, shall be paid by the buyer and will appear as separate items on the invoice unless a tax exemption certificate is on file with JMB Draft & Design.

 

8) LIMITATION OF LIABILITY

JMB Draft & Design will not be responsible for any losses, including but not limited to lost profits, lost income, loss of contracts, data loss, damages, compensation for emotional distress, costs, or other liabilities that might arise from using our website, its content, or any manufactured products, whether such losses are anticipated or not. JMB Draft & Design’s liability is limited to the total amount paid by the customer for their order.


9) ORDER CANCELLATION BY US

JMB Draft & Design reserves the right to decline or cancel your order at any stage of the ordering process, even after acceptance of the order. Reasons for such cancellation may include, but are not limited to, the impracticality of the model, infringing aspects of your 3D model, equipment maintenance or malfunctions, or issues related to the delivery address provided. If we cancel part or all of your order, we will notify you by email and, except in cases of fraud or policy violations, provide a full refund for the canceled item(s).


10) ENTIRE AGREEMENT

This document constitutes the entire agreement between the parties. It supersedes any prior understandings, agreements, representations, or warranties, whether oral or written, related to the products, including any statements or implications from past dealings not expressly included herein. No subsequent oral or written statement or agreement made after acceptance of the purchase order will modify these terms unless explicitly agreed to in writing by an authorized representative of JMB Draft & Design, with specific reference to this transaction or following its completion.


Return and Refund Policy

 This Refund and Return Policy (“Policy”) pertains to purchases of 3D printed and/or manufactured products from JMB Draft & Design Pty Ltd.

1. Overview

  • We provide refunds, repairs, and replacements in accordance with Australian Consumer Law and the terms described in this Policy (“Policy”).
  • The benefits described in this Policy are additional to your rights under Australian Consumer Law.
  • Please review this Policy before making a purchase to understand your rights and our obligations if you are dissatisfied with your order.

2. Definition of a Consumer

A consumer includes an individual, self-employed person, or business buying:

  • Goods or services valued at less than $40,000, or
  • Goods or services over $40,000 that are typically purchased for personal, household, or domestic use, or
  • A vehicle or trailer mainly used for transporting goods on public roads.

Purchasers who buy items for resale or transformation into products for sale are not deemed consumers.

3. Australian Consumer Law

  • According to Australian Consumer Law:
    • Our products and services are guaranteed under the law, and these guarantees cannot be excluded. For significant issues with our service, you have the right to cancel the service contract and receive a refund for the unused portion or compensation for its diminished value.
    • For major defects in goods, you can choose between a refund or replacement. For non-major defects, you are entitled to a repair within a reasonable timeframe. If the repair is not satisfactory, you can request a refund and cancel the service contract for any unused portion. Compensation is also available for any foreseeable loss or damage due to the defect.
  • We offer refunds, repairs, and replacements in line with Australian Consumer Law if reported within 14 days of receiving your product.
  • Australian Consumer Law outlines Consumer Guarantees that protect you when purchasing products and services.
  • If there is a conflict between this Policy and Australian Consumer Law, the latter will take precedence.
  • For more information on Australian Consumer Law and Consumer Guarantees, visit the Australian Competition and Consumer Commission’s website.
  • If a product or service has a major failure (as defined by Australian Consumer Law), you may be entitled to a replacement, refund, or compensation for foreseeable losses.
  • For minor failures, you may still be eligible for repair or replacement.

4. Exclusions

  • We are not liable for damages or losses arising from factors beyond our control once the goods have left our possession.

5. Limited Liability for Defects

  • JMB Draft & Design guarantees that the manufactured model will substantially match the specified 3D Model, within the constraints of 3D printing technology. If you provide your own 3D Model, you are solely responsible for its design and performance. We do not guarantee the suitability of the 3D Model for any specific purpose. Inspect the 3D Model upon arrival. If it is defective and you believe you deserve a replacement, contact us within 14 days of receipt. Do not return the model unless instructed. We may require the return of the model before issuing a replacement or refund.
  • We may request photographs to assess your claim. Models that have been altered or post-processed are not eligible for replacement or refund.
  • Customers acknowledge that, within the limits of applicable regulations, JMB Draft & Design is not responsible for any damages or losses arising from the use or inability to use the website or its contents. Our liability is limited to the amount paid for the current order.

6. Limitation of Liability

  • Neither we nor our directors, employees, agents, partners, or suppliers will be liable under any legal theory for:
    • Loss of income, profits, contracts, data, or costs associated with obtaining substitute goods or services, or for any indirect, incidental, special, punitive, or consequential damages,
    • Bugs, viruses, or other harmful elements (regardless of source),
    • Direct damages exceeding the greater of:
      • The fee received by us for services over the last three (3) months, or
      • A$250.00 (two hundred and fifty Australian dollars).

7. Warranties Against Defects

  • We will repair or replace defective goods but are not responsible for any consequential losses. This warranty does not cover products that have been repaired or altered.
  • A consumer must report issues within 14 days to allow us time to inspect the returned parts.

8. Cancellation and Change of Mind

  • We do not provide refunds if you change your mind or find a cheaper alternative elsewhere.

9. Products Damaged During Delivery

  • If your product arrives damaged:
    • Contact us immediately.
    • Return the damaged product with its original packaging and any accompanying items.
  • We will arrange for repair, collection, or replacement of the damaged product, or provide a refund, provided you contact us within 14 days of receiving the product.

10. Exceptions

  • We may refuse repair, replacement, or refund if:
    • The product was misused, causing the issue.
    • You were aware of the problem before purchasing.
    • You requested specific service or alterations against our advice, or were unclear about your request.
    • Any other exceptions under Australian Consumer Law apply.

11. Shipping Costs for Returns

  • If a product fails to meet Consumer Guarantees under Australian Consumer Law, we will cover the cost of returning the product and shipping a replacement.
  • For easily returnable products, you are responsible for arranging the return. If eligible for repair, replacement, or refund, we will reimburse reasonable postage costs.
  • For large or difficult-to-return products, we will arrange and cover the cost of shipping or collection.
  • If we arrange and pay for the inspection, postage, shipping, or collection of a returned product, and it is found not eligible for repair, replacement, or refund, you will be responsible for those costs.

12. Response Time

  • We aim to handle repair, replacement, or refund requests within 14 days of receipt.

13. How to Return Products

  • Contact us using the details provided at the end of this Policy to discuss returns.
  • Refunds will be issued in the same form as the original purchase or to the same account or credit card used.
  • Proof of purchase is required for refunds, repairs, or replacements.
  • Government-issued identification may be required to qualify for a refund, repair, or replacement.
